{"id":30265,"date":"2015-10-11T05:03:19","date_gmt":"2015-10-11T03:03:19","guid":{"rendered":"http:\/\/www.w-t-w.org\/en\/?p=30265"},"modified":"2015-10-11T05:05:17","modified_gmt":"2015-10-11T03:05:17","slug":"30265","status":"publish","type":"post","link":"https:\/\/www.w-t-w.org\/en\/30265\/","title":{"rendered":"US Plays Catch Up on Digital Privacy"},"content":{"rendered":"<p>California&#8217;s governor Jerry Brown has\u00a0signed into law\u00a0the most sweeping and stringent digital privacy law in the country on Thursday.<\/p>\n<div class=\"contentpaneopen size  artp\">\n<div class=\"art02\">\n<div class=\"txtimg\">\n<p class=\"indent\">The American Civil Liberties Union\u00a0called it\u00a0a &#8220;landmark victory for digital privacy.&#8221;<\/p>\n<p class=\"indent\">In essence, the law requires a warrant before any business turns over any of its clients&#8217; metadata or digital communications to the government.<\/p>\n<p class=\"indent\"><strong><a href=\"http:\/\/www.wired.com\/2015\/10\/california-now-nations-best-digital-privacy-law\/\" target=\"_blank\">Wired reports<\/a>:<\/strong><\/p>\n<blockquote><p>&#8220;State senators Mark Leno (D-San Francisco) and Joel Anderson (R-Alpine) wrote the legislation earlier this year to give digital data the same kinds of protection that non-digital communications have.<\/p>\n<p>&#8220;&#8216;For what logical reason should a handwritten letter stored in a desk drawer enjoy more protection from warrantless government surveillance than an email sent to a colleague or a text message to a loved one?&#8217; Leno said earlier this year. &#8216;This is nonsensical and violates the right to liberty and privacy that every Californian expects under the constitution.&#8217;<\/p>\n<p>&#8220;The bill enjoyed widespread support among civil libertarians like the American Civil Liberties Union and the Electronic Frontier Foundation as well as tech companies like Apple, Google, Facebook, Dropbox, LinkedIn, and Twitter, which have headquarters in California. It also had huge bipartisan support among state lawmakers.&#8221;<\/p><\/blockquote>\n<p class=\"indent\">The ACLU said it hopes the California Electronic Communications Privacy Act becomes a model for other states.<\/p>\n<p class=\"indent\">Under the federal Electronic Privacy Communication Act, the government can access digital data using a subpoena instead of a warrant.
